Trump’s bid to remove transgender or nonbinary designations from passports rejected by appeals court

A federal appeals court rejected President Trump’s attempt to reinstate a passport policy requiring individuals to list their biological sex at birth. The court upheld lower rulings that blocked the policy, citing potential harm to transgender and nonbinary Americans, including increased risk of harassment while traveling. The judges found the administration failed to justify the policy and did not adequately address claims of unconstitutional bias. The prior State Department policy allowed applicants to choose “M,” “F,” or “X” as gender markers without matching “biological sex.”
